A clear reference for working together

Website Terms and Conditions

These terms explain how you may use the S.W.P. Cognition website and how our analytics work is agreed. A written proposal sets the terms for a specific engagement where it differs from this page.

Current version

This page shows the terms currently in use. We may revise them; the version published here applies to website use from the date it is posted.

01 / Using the site

Acceptable Use of This Website and Our Services

You may use this website to understand our analytics services and make a genuine enquiry. Use it lawfully and do not interfere with other visitors or the systems that keep it available.

Clause 1.1

Use the site responsibly

Do not try to gain unauthorised access, disrupt the website, introduce harmful code, probe its security or misuse an enquiry form. Do not send information you know to be false, misleading or unlawful.

Clause 1.2

Share accurate enquiry details

Give us accurate contact details and enough context to understand your request. We may be unable to respond if your details are incomplete or cannot be verified.

Clause 1.3

Keep client access secure

If we give you access to a dashboard, model or reporting environment, use it only for the agreed purpose. Protect your login details, follow any access instructions and tell us promptly if you suspect unauthorised use.

Clause 1.4

Access can be withdrawn

We may restrict or withdraw website or client-environment access if we reasonably believe these terms have been breached, security is at risk or access is being misused. We will consider any active service agreement when doing so.

Use the systems you have been given access to. Nothing more.

02 / Ownership and scope

Intellectual Property and Service Proposals

Website material, project deliverables and client data are treated separately. Your signed or otherwise accepted proposal is the place to check the specific scope, fees and ownership terms for an engagement.

Clause 2.1

Website material

Text, graphics, layouts and other material on this website belong to S.W.P. Cognition or the relevant rights holder. You may view and refer to them for your own evaluation of our services. Do not republish, alter or commercially reuse them without permission.

Clause 2.2

Client data and deliverables

Your data remains yours. The proposal for your project will state how ownership and permitted use apply to dashboards, models, code, documentation and other deliverables, including any pre-existing materials or third-party components.

Clause 2.3

Proposals and changes

A proposal should set out the agreed work, assumptions, fees, timing and relevant service terms. Work begins when both sides accept the proposal in the manner it specifies. Changes to scope or timing must be agreed in writing.

Clause 2.4

Pre-contract discussions

During discussions, each side should take reasonable care with information it shares in confidence. If a separate confidentiality agreement applies, its terms govern that information. This clause does not create a wider confidentiality agreement by itself.

For a specific engagement, the written proposal takes precedence over these general website terms where the two conflict on that engagement.

03 / Information and responsibility

Enquiries, Third-Party Services and Limitations

We review website enquiries and respond where a useful next step is clear. Sending an enquiry does not itself create a client relationship or commit either side to a project.

Clause 3.1

How enquiries are handled

We use the details you submit to review and respond to your request. We do not promise a particular response time or that every enquiry will lead to a proposal. See our Privacy Notice for information about personal data.

Clause 3.2

External services and links

The website may rely on third-party hosting, communications, analytics or other services, and may link to external websites. Those providers control their own services and terms. We are not responsible for content or availability outside our control.

Clause 3.3

Accuracy and outcomes

We take care with website information, but it may be incomplete, change over time or contain errors. We do not promise a specific commercial result based on website content alone. Project-specific commitments belong in the relevant proposal.

Clause 3.4

Liability

To the extent permitted by law, S.W.P. Cognition is not liable for losses arising from reliance on general website information or from events beyond our reasonable control. Any liability for services is governed by the relevant written proposal. Nothing in these terms excludes or limits liability where the law does not allow it, including liability for fraud or for death or personal injury caused by negligence.

04 / Legal details

Governing Law, Jurisdiction and Questions

These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, subject to any rights you have under applicable law.

Changes. We may update these terms by publishing a revised version on this page. The revised terms apply to website use from the date they are posted. Any change to an active service engagement must follow the change process in its proposal.

Personal information. Our Privacy Notice explains how personal information submitted through the website is handled.

S.W.P. Cognition is based in Colchester, Essex, United Kingdom.
